By accessing or using Pietschy services, you agree to be bound by these Terms of Use and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Service Description

Pietschy provides artificial intelligence-powered automation and integration services for title, escrow, accounting, and related industries. Our services include:

  • Document processing and analysis
  • Workflow automation
  • System integrations and API connections
  • Data extraction and classification
  • Fraud detection and security monitoring

Account Registration

To use our services, you must:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Promptly update account information as needed
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

Acceptable Use Policy

Prohibited Activities

You may not use our services for any illegal, harmful, or unauthorized purposes.

You agree NOT to:

  • Violate any applicable laws or regulations
  • Infringe upon intellectual property rights
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to systems

Intellectual Property

Our IP

All content, features, and functionality of Pietschy services are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

Your Data

You retain all rights to your data. By using our services, you grant us a limited license to process your data solely for providing the services. We do not claim ownership of your content.

Payment Terms

  • Subscription fees are billed in advance on a recurring basis
  • Prices are subject to change with 30 days notice
  • All payments are non-refundable except as required by law
  • Failure to pay may result in service suspension or termination
  • You are responsible for all applicable taxes

Service Availability

We strive to maintain 99.9% uptime, but we do not guarantee uninterrupted service. We reserve the right to:

  • Modify or discontinue services with notice
  • Perform scheduled maintenance and updates
  • Temporarily suspend service for security or technical reasons

Limitation of Liability

Important Legal Notice

Pietschy is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, or consequential damages.

To the maximum extent permitted by law, Pietschy shall not be liable for any damages arising from your use of our services, including but not limited to data loss, business interruption, or lost profits. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

Contractor Status & Scope of Liability

Independent Contractor Relationship

Pietschy operates as an independent contractor providing software and AI services. We are not employees, agents, partners, or joint venturers with any client or user.

Limited Liability: Our liability for work performed and data protection is strictly limited to:

  • Obligations explicitly defined in a prior written contractual agreement
  • Terms and conditions agreed upon before work commencement
  • Scope of services specifically outlined in executed contracts or statements of work

No liability is assumed for any work, data protection, results, or outcomes beyond those contractually agreed upon in writing prior to service delivery. General use of our platform does not create additional contractual obligations beyond these Terms of Use.

For enterprise clients with custom contracts: specific liability terms in your executed agreement supersede this general provision.

Indemnification

You agree to indemnify and hold harmless Pietschy from any claims, damages, or expenses arising from your use of our services, violation of these terms, or infringement of any rights of another party.

Data Processing & AI

By using our services, you acknowledge that:

  • AI-generated outputs may contain errors or inaccuracies
  • You are responsible for reviewing and validating AI outputs
  • We process data in accordance with our Privacy Policy
  • Your data is not used to train public AI models
  • You maintain responsibility for decisions based on AI insights

Termination

Either party may terminate this agreement:

  • With 30 days written notice
  • Immediately for material breach
  • Immediately for non-payment (after grace period)

Upon termination, your access to services will cease, and you must stop using our intellectual property. We will retain your data for a reasonable period to allow export, then permanently delete it.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in the courts of [Your Jurisdiction].

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or service notification. Continued use of our services after changes constitutes acceptance of the new terms.

Severability
